Kasoa ritual murder: 15-year-old convicted minor to receive sentencing in Juvenile Court by November 12.

 

An Accra High Court, led by Justice Lydia Osei Marfo, has ordered that a 15-year-old convict, who was found guilty alongside 18-year-old Nicholas Kini, be sent to the Juvenile Court for sentencing by November 12, 2024.

On October 24, a seven-member jury panel unanimously convicted both the juvenile, now 18, and Nicholas Kini, now 21, on charges of conspiracy and murder.

Due to his age, Nicholas Kini received a life sentence in adult court, while the juvenile’s sentencing was deferred to the Juvenile Court. Justice Marfo cited Article 140 of the 1992 Constitution, which grants the High Court jurisdiction over capital offenses involving minors but limits its authority in sentencing.

As a result, the High Court cannot impose a sentence on the first accused and has therefore referred him to the Juvenile Court within its jurisdiction. Justice Marfo ordered that he remain in police custody until November 12, 2024, when he is scheduled for sentencing according to juvenile law.
